$50,000 Recovery in Extraordinary Defective Pool Case—Eight Years After Construction
Sometimes a construction defect does not reveal itself immediately.
Sometimes it takes eight years.
In one extraordinary August matter, The Moster Law Firm represented homeowners in a dispute arising from the construction of their swimming pool. During the original construction, employees of the pool contractor improperly disposed of excess pool plaster by flushing it into the home’s sewer system.
The consequences were not immediately apparent.
Years passed.
Then the plumbing problems began.
Approximately eight years after the pool was constructed, the improperly discarded plaster contributed to blocked sewer pipes, leaving our clients facing substantial damage and a difficult legal battle over conduct that had occurred nearly a decade earlier.
Cases involving delayed construction damage can be particularly challenging. Contractors and their insurers frequently argue that too much time has passed, that the connection between the original work and the later damage cannot be established, or that the homeowner should bear the cost.
The Firm refused to accept that result.
Our attorneys developed the evidence connecting the plumbing failure to the contractor’s original conduct and aggressively pursued recovery for our clients.
The case ultimately proceeded to mediation.
Our clients had approximately $19,000 in actual damages.
The settlement?
$50,000.
That represents a recovery of more than two-and-a-half times the client’s actual damages and demonstrates the leverage that can be created through careful investigation, legal preparation, and aggressive negotiation.
The case also illustrates an important lesson for Texas homeowners: the passage of time does not necessarily mean that a construction claim should be abandoned—particularly when the true cause of the damage could not reasonably have been discovered earlier.

Contractors Return to Complete Abandoned Construction Project
Not every successful case ends with someone writing a settlement check.
Sometimes the most valuable result is getting the project finished.
In one particularly difficult matter, our client was left facing an unfinished construction project after contractors who had already been retained and paid stopped performing their work and abandoned the project.
The consequences were substantial.
Construction delays can create a financial domino effect—additional carrying costs, lost business opportunities, replacement contractor expenses, scheduling problems, and other losses that continue accumulating for every day the project remains unfinished.
For this client, those losses had become enormous.
The client was suffering financial damages exceeding $2,000 every day the project remained incomplete.
The Moster Law Firm intervened and issued multiple demands insisting that the contractors honor their obligations.
The pressure worked.
Both contractors ultimately returned to the project site and agreed to resume and complete the work for which they had already been contracted and paid.
That result stopped an escalating financial crisis and provided our client with what litigation is ultimately supposed to provide—a practical solution to a real-world problem.
Instead of simply pursuing damages months or years later, the Firm’s intervention helped get the project moving again.

Mortgage Payment Restored Following Property Tax Crisis
For homeowners, an unexpected increase in a mortgage payment can quickly become a financial emergency.
That is exactly what occurred in another August matter handled by The Moster Law Firm.
A retroactive property tax assessment resulted in a substantial increase in our client’s property taxes. Those increased taxes were then reflected in the client’s mortgage obligations, causing the monthly mortgage payment to rise to an amount the client could no longer financially afford.
The consequences could have become devastating.
The Firm intervened and worked to obtain relief.
The result was significant:
The mortgage company restored the client’s monthly mortgage payment to its original amount.
That immediately provided meaningful financial relief and helped stabilize the client’s housing situation.
But our work is not finished.
The Firm continues to pursue relief with the appropriate taxing authorities in an effort to obtain a waiver of penalties and other additional charges resulting from the retroactive assessment.
This matter illustrates an important part of our approach to litigation and dispute resolution. A successful lawyer must understand what the client actually needs—not simply what causes of action can be placed in a lawsuit.
Here, the immediate priority was clear: get the mortgage payment back down.
That objective was accomplished.
The Firm is now working on the remaining financial consequences.
