June was one of the most successful months in Firm history. Because many of these matters resolved through confidential settlement agreements containing non-disclosure provisions, we cannot identify the parties involved. We can, however, share the victories—and recognize the attorneys whose skill and persistence made them possible

Major Victory Against Egregious Contractor in Home Construction Arbitration

Some contractors simply fail to perform. Others leave behind a trail of destruction.

Our Austin office represented a homeowner who hired a contractor to construct an outdoor living project consisting of a patio, fire pit, pergola, fencing, landscaping, and related improvements. Instead of delivering the quality project promised, the contractor performed defective work, repeatedly demolished and repoured concrete, damaged existing improvements, abandoned the project, and ultimately walked away after receiving substantial payments. The homeowner was forced to hire replacement contractors at dramatically increased cost while living with an unfinished and hazardous project.

The Moster Law Firm immediately launched an aggressive investigation and pursued claims for breach of contract, fraud, fraud in the inducement, negligence, violations of the Texas Deceptive Trade Practices Act (DTPA), conversion, breach of implied warranty, and violations of the Texas Construction Trust Fund Act. These statutory claims significantly increased the contractor’s exposure by permitting recovery of attorney’s fees, additional damages, and other remedies provided under Texas law.

Our litigation strategy resulted in an outstanding resolution for our client in the amount of $200,000.00!

$150,000 Construction Defect Settlement

Construction defect cases are rarely about a single defect. More often they involve a pattern of poor workmanship, repeated failed repairs, and a builder who hopes the homeowner eventually gives up.

In one confidential matter, the builder entered mediation offering more than $100,000.00 to resolve the dispute. Through continued negotiations after mediation, our attorneys increased that offer by nearly fifty percent.

The claims involved violations of the Residential Construction Liability Act (RCLA) together with Texas DTPA claims arising from the contractor’s conduct.

Solar Company Walks Away — Client Walks Free

Solar litigation continues to be one of the fastest-growing areas of our practice.

Many consumers discover that promises made during the sales process bear little resemblance to the contracts they eventually sign. We routinely pursue claims involving deceptive sales practices, misrepresentations, installation failures, financing irregularities, and violations of the Texas DTPA.

In one June matter, the solar provider agreed to completely rescind the transaction, transfer ownership of the partially installed system without additional cost, and release our client from further obligations.

Defective Pool Contractors Continue to Be Held Accountable

Pool failures have become one of the Firm’s signature practice areas. We represent homeowners throughout Texas involving structural failures, pool cancer, soil movement, engineering defects, plumbing failures, and defective construction.

June alone produced multiple significant victories.

One confidential matter resulted in a judgment of approximately $158,000 against a defective pool contractor.

A second pool matter produced a recovery of approximately $163,000.

Another pool dispute resulted in a $39,000 judgment against the contractor after defective work damaged the homeowner’s investment.

Builder Pays to Resolve Construction Defect Claims

When builders refuse to properly address construction defects, the RCLA provides powerful legal remedies requiring them to repair or compensate homeowners for defective construction. Combined with DTPA claims where appropriate, these statutes frequently create substantial leverage.

In one confidential June matter, the Firm successfully negotiated a $45,000 settlement involving construction defects with damages substantially below the ultimate recovery.

In another confidential matter, the Firm secured a $30,000 settlement from a residential builder without requiring extended litigation.

Commercial Client Achieves Complete Recovery

Aggressive litigation strategy often changes the negotiating landscape.

In a commercial dispute resolved through mediation, the Firm obtained 100% of the client’s actual damages, together with statutory damages under the Texas Theft Liability Act and attorney’s fees. The settlement was further secured through an agreed judgment protecting the client’s future recovery.

Solar Victories Continue Across Texas

The Firm obtained several additional successful outcomes involving residential solar disputes during June.

In one matter, the client’s financing company agreed to forgive the remaining loan balance and pay attorney’s fees.

In another, the solar company agreed to reduce the client’s financial obligation by approximately 80%, providing enormous financial relief.

In a separate matter, our attorneys successfully obtained a complete release from an unfavorable consumer contract.

Congratulations to our attorneys handling these matters for continuing to protect Texas consumers from abusive and deceptive solar industry practices.

Commercial Litigation Success

The Firm also secured victories outside the construction arena.

Among the month’s successes were:

· A successful breach of contract judgment of approximately $25,000.

· Dismissal of all claims against a Firm client in contested litigation, together with recovery of attorney’s fees.

· A substantial confidential commercial settlement exceeding $60,000.

These matters demonstrate that aggressive preparation and strategic litigation benefit clients in every practice area.
