$268,000 Default Judgment After Pool Contractor Abandons an $80,000 Project
Our client paid $80,000 for a swimming pool.
What remained when the contractor abandoned the project was essentially a hole in the ground and a damaged pool shell.
According to the client’s account, the contractor cracked the fiberglass pool on multiple occasions before walking away from the unfinished job. The client was left confronting both the money already spent and the additional expense of completing the project.
An unfinished pool can turn a major investment in a home into a continuing source of frustration. The homeowner must determine what can be repaired, what must be replaced, and who will pay to finish the work.
The Moster Law Firm pursued the contractor’s financial responsibility through the courts.
The result: a signed default judgment for $268,000.
That judgment established a substantial monetary award in our client’s favor. It represents an important legal victory arising from a project that the contractor left unfinished.

Firm Successfully Defends $5 Million Home Against Eviction and Condemnation
Sometimes the most important victory is protecting what a client already has.
In one September matter, the stakes included our client’s $5 million home.
The client faced a Board of Adjustments proceeding involving threatened eviction and condemnation. A ruling against the client could have had enormous personal and financial consequences.
Senior Attorney Kevin Green of our Austin office defended the client in a contentious evidentiary hearing lasting approximately four hours.
The outcome was decisive.
The Board rejected the city planning office’s position and ruled in our client’s favor.
Afterward, the client credited the Firm’s “great work over the four painful hours” and wrote that he had “thought for sure I was getting kicked out of my home.”
That response captures what the proceeding meant to the person whose home was at stake.
For the client, this was a fight to protect a place to live and a substantial investment. The Firm’s successful defense delivered the favorable ruling the client needed.

$70,000 Settlement in Defective Pool and Patio Dispute
A $200,000 pool and patio project should be a source of enjoyment.
For these homeowners, it became a source of serious construction problems.
The clients reported a flooded outdoor kitchen, damaged tile, a malfunctioning sump pump that allowed water to accumulate on the front lawn, and acid damage to new appliances that required replacement.
They also reported that elements of the project had been installed in locations inconsistent with the contract and raised concerns about electrical and plumbing work performed by unlicensed workers.
The dispute extended beyond the quality of the original construction. The homeowners also alleged that the contractor had misrepresented its obligations to replace damaged and defective work.
The Moster Law Firm pursued relief for the homeowners.
The result: a $70,000 settlement.
The settlement provided a meaningful financial resolution to a dispute involving numerous defects in an expensive outdoor construction project.

For the client, the objective was practical: obtain financial relief that addressed the contractor’s failure to deliver the promised work.

The result: $32,000—satisfying the full demand and securing an additional $5,000.
That outcome gave the client a meaningful financial result in a dispute arising from abandoned and defective construction.

When a property dispute involves multiple defendants, resolving one part of the case requires careful attention to what happens to the rest.
In a challenging private nuisance and property damage matter, The Moster Law Firm pursued relief for a client whose claims involved more than one defendant.
The case presented real difficulties. Attorney Promise Aryansiji of our Dallas office continued pressing for a resolution that would benefit the client while protecting the remaining claims.
The result: a $30,000 settlement with one defendant, with the client’s claims against the other defendants preserved.
That distinction matters.
The client obtained a settlement without giving up the opportunity to pursue relief from the other parties still involved in the dispute.

In another pool construction matter, our client faced damage to the home after the pool builder pumped plaster and Gunite into the sewer line.
Materials that should never have entered the home’s plumbing system instead created a costly repair problem. The Moster Law Firm pursued the builder’s responsibility for that damage.
The result: a $50,000 settlement covering the repairs and attorney’s fees.
The settlement addressed both the damage to the home and the attorney’s fees incurred in pursuing the claim.

Complete Solar Loan Cancellation Plus a $5,000 Settlement Payment
A disputed solar loan can leave a homeowner facing years of payments. In one September matter, The Moster Law Firm secured an agreement that will eliminate the client’s entire remaining loan balance.
Senior Attorney Erica Porter of our Dallas office negotiated a settlement requiring the lender to cancel all remaining principal, interest, and penalties.
The agreement also provides for a $5,000 payment to the Firm’s trust account, inclusive of attorney’s fees and costs.
The result: complete cancellation of the remaining loan balance, plus a $5,000 settlement payment that includes attorney’s fees and costs.
For the client, this resolution removes the burden of the remaining loan obligation and provides an additional monetary payment under the settlement.
