Big Victory for Rights of the Disabled

The Moster Law Firm is proud to announce a successful settlement in a lawsuit filed against a large car dealership in West Texas – Benny Boyd.

Our Firm joined forces with the excellent attorneys of the Equal Employment Opportunity Commission (EEOC) to prosecute the rights of Randall Hurst, the former manager of the Benny Boyd car location in Lubbock, Texas. The complaint filed in federal court in Lubbock alleged illegal disability discrimination based on Mr. Hurst’s medical condition in which he was diagnosed with multiple sclerosis. The American Disability Act prohibits discrimination in the workplace. The suit alleged that Mr. Hurst’s supervisor subjected him to demeaning comments including asking him “What’s wrong with you? Are you a cripple?” and “You are on your last quarter, buddy, since you have MS”. Mr. Hurst quit his job as a result.

Benny Boyd agreed to pay Mr. Hurst the sum of $250,000.00 in settlement of the litigation which was approved by the Federal Court in Lubbock, Texas.

This case is a big victory to people with MS and will hopefully deter further acts of discrimination in the workplace.

Although the Moster Law Firm principally represents business clients, our core value and mission is to instill “best practices” and compliance. The key to business success and avoidance of costly litigation is to understand the requirements imposed by state and federal employment laws. Understanding and implementing these laws is a win-win for our business clients and their employees.

Congratulations to Mr. Hurst and the EEOC!
